Asset Medikal Design Sanayi ve Ticaret A.Ş. As (“Asset Medikal”); we have prepared this clarification text in order to inform you, our Visitors, Online Visitors, Customers, Potential Customers, Supplier Employees, and Supplier Executives regarding the processing, storage, and transfer of your personal data within the framework of the Personal Data Protection Law No.6698 ("PDPL") and related legislation and legal regulations.
1. What Are the Categories of Personal Data We Process and For What Purposes Do We Process Them?
According to the following clauses of PDPL’s Clause 4.2.;
(i) Compliance with the rule of law and honesty,
(ii) Being accurate and up-to-date,
(iii) Processing for specific, explicit, and legitimate purposes,
(iv) Being connected, limited, and restrained with the purpose for which they are processed,
(v) To be stored for the period required by the relevant legislation or for the purpose for which they are processed.
In accordance with these principles, Asset Medikal may process the personal data of our business partners for the purposes stated below within the scope of our ongoing business relations with our business partners (it is possible for a party to fall into more than one category).
1.1. Visitors
Physical location security information (eg, camera recordings);
• Data will be processed for the purposes of ensuring physical location security.
1.2. Online Visitors
Identity information, contact information (eg, e-mail address) of our online visitors using our website (if the visitor notify us with these information); will be processed for the following activities;
• Implementation of activities per the legislation,
• Processing of information security processes,
• Follow-up of requests/complaints,
• Execution of communication activities,
• Relaying information to authorized persons, institutions and organizations.
1.3. Customers
Identity information, customer contact information (eg. Purchase information), physical location security information, financial information (eg. Balance information), legal procedure information, marketing information (eg. Purchase history information) of officials and/or customers of our real person customers or legal person customers, will be processed for the following activities;
• Performing of activities in accordance with the legislation,
• Execution of finance and accounting works,
• Carrying out/supervision of business activities,
• Evaluation of logistics activities,
• Administration of after-sales support services for goods/services,
• Execution of goods/service sales processes,
• Processing of marketing analysis studies,
• Execution of contract processes,
• Relaying information to authorized persons, institutions, and organizations,
• Ensuring physical location security,
• Resolving legal disputes,
• Evaluation of storage and archive activities,
• Scrutinization of risk management processes,
• Examination of advertisement/campaign/promotion processes,
• Fulfillment of company/product/service commitment processes,
• Performing the communication activities.
1.4. Potential Customers
Identity information, contact information, customer transaction information, physical location security information, marketing information of employees and/or customers of our real person customers or legal entity customers; will be processed for the following activities;
• Managing goods/service sales processes,
• Performing contract processes,
• Ensuring physical location security,
• Evaluation of advertisement/campaign/promotion processes,
• Examining of marketing analysis studies.
1.5. Supplier Employee
Identity information, contact information, physical location safety information, professional experience information (eg, in-service training information) of our supplier employee; will be processed for the following activities;
• Enaction of communication activities,
• Execution/supervision of business activities,
• Ensuring physical location security,
• Administration of supply chain management processes,
• Performing the logistics activities,
• Carrying out activities per the legislation,
• Enforcementnt of occupational health/safety activities
1.6. Supplier Executives
Identity information, contact information, physical location security information, customer transaction information, financial information, marketing information, legal transaction information of our real person suppliers or legal person supplier executives; will be processed for the following activities;
• Evaluation/supervision of business activities,
• Execution of goods/service purchasing processes,
• Implementation of finance and accounting works,
• Carrying out the contract processes,
• Enactment of investment processes,
• Ensuring physical location security,
• Follow-up and execution of legal affairs
2. What are the Collection Methods of Your Personal Data?
Your personal data specified in categories above, are collected by physical means such as order forms, contracts, visitor forms, or by automatic or non-automatic means through information systems and electronic devices (eg. Telecommunication infrastructure, computer and phones) third parties (eg. KKB and Findeks), our website and other documents declared by the person concerned.
3. What is the Legal Reason for Collecting Your Personal Data?
Your personal data is processed by Asset Medikal in line with the purposes described above, based on the following legal reasons stated in the 5th Article of PDPL;
(i) It is explicitly prescribed by the law.
(ii) The processing of the personal data belonging to the parties to the contract is necessary, provided that it is directly related to the performance of the contract.
(iii) It is mandatory for the data controller to fulfill its legal obligations.
(iv) The data processing is mandatory for the establishment, exercise of protection of a right.
(v) Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the person concerned.
When the data processing activity cannot be based on one of the above legal reasons, your personal data is processed based on your explicit consent.
4. Do We Transfer Your Personal Data to a Third Party?
a) Personal data of our visitors may be shared with law enforcement and judicial authorities in order to resolve legal disputes and upon request in accordance with the relevant legislation.
b) Personal data of our online visitors may be shared with judicial authorities and authorized public institutions and organizations, upon request, in order to resolve legal disputes and in accordance with the relevant legislation.
c) Personal data belonging to our customers, may be transferred to authorized public institutions and organizations in order to carry out activities in accordance with the legislation, to follow up and execute legal affairs, and to inform authorized persons, institutions and organizations, within the scope stipulated by legal regulations, and can be transferred to our group companies, suppliers, cargo companies, insurance companies, banks and our financial advisors to the extent necessary in order to conduct/audit business activities, carry out risk management processes, and perform our services properly. In addition, the personal data in question may be transferred to the law firm and judicial authorities from which we receive services so that they can be used as evidence in resolving future legal disputes.
d) Personal data of our potential customers may be transferred to the law office and judicial authorities from which we receive service in order to be used as evidence in resolving future legal disputes.
e) Personal data of our supplier employees, within the scope of the legislation, may be transferred to authorized public institutions and organizations in accordance with the legislation for the purposes of executing activities, following and executing legal affairs, informing authorized persons, institutions and organizations, and conducting/supervision of business activities and also may be transferred to group companies, suppliers, cargo companies, banks and our financial advisors to the extent necessary in order to perform the service properly. In addition, the personal data in question may be transferred to the law firm and judicial authorities from which we receive services so that they can be used as evidence in resolving future legal disputes.
f) Personal data of our supplier executives, may be transmitted to authorized public institutions and organizations in accordance with the legislation, for the purpose of conducting activities, following and executing legal affairs, informing authorized persons, institutions and organizations, and conducting/supervising business activities, within the scope stipulated by legal regulations, and also may be transferred to group companies, suppliers, cargo companies, banks and our financial advisors to the extent necessary in order to perform the service properly. In addition, the personal data in question may be transferred to the law firm and judicial authorities from which we receive services so that they can be used as evidence in resolving future legal disputes.
5. Do We Transfer Your Personal Data Abroad?
As Asset Medikal, we do not transfer your personal data abroad.
6. How Can You Exercise Your Rights Regarding Your Personal Data?
You can submit your requests within the scope of Article 11 of the PDPL, which regulates the rights of the persons concerned, via the "Application to the Data Controller" prepared for your convenience in accordance with the "Notice on the Procedures and Principles of Application to the Data Controller" on the “http://www.assetmedical.com/”, website of Asset Medikal.
